CBS Wants Court Order Compelling FilmOn To Remove Online “Inflammatory” Anti-Network Material
Another month, another salvo in the on-going multi-pronged legal trench warfare between the broadcasters and FilmOn founder Alki David. This time, it’s CBS who is back in court against the billionaire digital media entrepreneur.
CBS Interactive Can't Escape Claims of Inducing Piracy
Can editorial commentary be held legally responsible for the theft of music and movies? A district court judge suggests yes, allowing Alki David's lawsuit against the network for promoting and distributing Limewire to go forward.
Piracy case vs. CBS gets judicial OK
A federal judge has rejected CBS Interactive's efforts to dismiss all elements of a lawsuit claiming that the company-owned CNET induced copyright infringement by making file-sharing software accessible via Download.com. U.S. District Judge Dale Fischer's decision is one development in what could be lengthy litigation but it is perhaps more notable for its named plaintiff: colorful digital media entrepreneur Alki David.
Setback for CBS, CNET in LimeWire Copyright Infringement Case
David Alki and his coalition of artists say they've had a "huge win" against CBS owned CNET, in a case relating to the distribution of music sharing software LimeWire. A major victory has been scored for FilmOn founder David Alki's in his lawsuit against CNET, and its parent CBS. Alki accused tech giant CNET of copyright infringement in a highly controversial case relating to file sharing software LimeWire.
Federal Court Ruling Puts CBS in Hot Water Over Mass Online Piracy
LOS ANGELES, July 13, 2012 (GLOBE NEWSWIRE) -- (www.FilmOn.com) - Federal Judge Dale S. Fischer today denied the CBS & CNET.com motion to dismiss claims against them of mass online piracy. Though the claims for "Vicarious Liability" against them were denied, the "Inducement" claim was clearly upheld. Judge Fischer also granted Alkiviades (Alki) David et al. the option to amend their "Vicarious Liability" claims at a later date.

CBS Interactive, the owner of CNET, is being sued for facilitating "massive copyright infringement" for distributing the LimeWire software, a file sharing service a federal judge ruled illegal last year.
A lawsuit brought by rappers and others accuses CBS of profiting from distributing 220 million copies of LimeWire on CNET's download.com site since 2008, or 95 percent off all LimeWire downloads.
"The CBS defendants received massive amounts of revenue from P2P provders on a 'pay per download' basis and also from advertising revenues generated by advertisements placed on the download screen for P2P software," (.pdf) according to the complaint, lodged in Los Angeles federal court late Tuesday.
CBS Sued for Millions by Rappers For Illegal Downloads
Rappers like The Ying Yang Twins, 2 Live Crew, JT Money, The Force MDS, J-Shin and singing group Pretty Ricky filed the lawsuit in U.S. District Court for the Central District of California yesterday (May 3rd).
The lawsuit claims CBS Interactive's website CNET was the main distributor of the LimeWire peer2peer sharing software, which was been downloaded over 220 million times.
In addition to LimeWire, CNET helped distribute such popular programs as Morpheus (174 million downloads), iMesh (115 million downloads) and FrostWire (32 million downloads).
Rappers Sue CBS, CNET For Millions Over Illegal Downloads

Coalition of Artists Sue CBS Interactive, CNET for Mass-Scale Copyright Infringement
This lawsuit is based on the defendants' direct participation in massive copyright infringement on peer-to-peer ("P2P") systems, such as LimeWire, that are used to copy and distribute songs, films and other artistic works. LimeWire and its principals have already been found liable for copyright infringement on a virtually unprecedented scale and have been enjoined from further infringing activities by a New York federal court. As alleged in today's lawsuit, CBS Interactive and CNET have acted as the main distributor of LimeWire software and have promoted this and other P2P systems to profit from wide-scale copyright infringement.
Internet users have downloaded more than 220 million copies of LimeWire software from these defendants' website since 2008, which is some 95 percent or more of all copies of LimeWire that were downloaded until LimeWire was shut down by Court Order. Defendants' website also has been a major source for other P2P software applications, including FrostWire (32 million downloads).
Billionaire Alki David strikes back at CBS over its distribution of LimeWire and other P2P software.
Just as a big jury trial in New York gets underway that will determine whether LimeWire owes billions of dollars in damages for inducing rampant copyright violations on its file-sharing network, CBS Interactive is now being sued in a separate lawsuit that looks to punish it for playing a role in LimeWire's growth.
The new lawsuit is spearheaded by Alki David, an eccentric billionaire whose company, FilmOn, is the subject of ongoing litigation brought by major broadcast networks, including CBS. Now, David seems to be exacting revenge in a style befitting his whimsical ways -- by recruiting a handful of hip hop artists including members of 2 Live Crew and Ying Yang Twins to press the case that CBS subsidiary CNET contributed to the growth of the copyright-disrespecting file-sharing era.
